Hmmm...always have the right of refusal here unless you have hurt someone in a crash, then they will do a forced draw. Here there has to be probable cause to test for anything other than alcohol and the person better be charged with under the influence of a controlled substance if you test for it. Civil rights are not considered optional - but then, this is Northern California...
